Because of social contracts, there is no real tragedy of the commons unless the commons disappear. This is called enclosure. It is why we have the Magna Carta and also the Marxist philosophy. In other words, what happens when the pond is owned by one person one king or one corporation and no longer part of the commons. People are forced to work for that corporation and buy the fish from it as well, all in the service of profit for the king or the corporation.
